Legionella risk assessments

Under the HSE’s ACoP L8, anyone in control of premises (employers, landlords, and those managing water systems) has a duty to assess and control the risk from legionella. For rental properties this includes ordinary domestic lets; the assessment can be simple, but it must exist.

The law requires the assessor to be competent, not to hold a specific licence. Many are carried out by trained plumbing and heating engineers, inventory professionals, or specialist water hygiene assessors. For complex systems (cooling towers, large stored-water systems), specialist firms are the norm and LCA registration is the recognised competence benchmark.

ACoP L8 requires the assessment to be reviewed regularly and immediately whenever there is reason to believe it is no longer valid, for example after system alterations, a change of use, or a positive test. There is no fixed statutory expiry.
